Liability for False Statements

Please be advised that under Illinois law, it is a felony to falsely represent the status of a person or entity as minority-owned, female-owned, or as owned by a person with a disability, in obtaining a governmental contract. In addition, any person convicted of this offense must pay a penalty equal to one and a half times the amount of the contract. 720 ILCS 5/17-29. False, fraudulent, or deceitful statements made in connection with DBE participation in federal Department of Transportation assisted programs could result in liability under 49 CFR Part 31, Program Fraud and Civil Remedies and possible prosecution under 18 U.S.C. 1001.

In addition, as a condition of submitting a DBE application, you also acknowledge that the CTA may disclose and transfer any information that you provide to (i) any UCP participating entity; and (ii) the federal Department of Transportation in any certification appeal under 49 CFR §26.89 in which the disadvantaged status of the individual is in question or in connection with a appeal or challenge to DBE certification in accordance with 49 CFR §26.67(a)(2)(iv). In addition, certain information may be subject to disclosure under the Illinois Freedom of Information Act, 5 ILCS 140/1 et seq., or under other state, federal or local laws.
